Internet User Privacy
Policy

OmegaNeT respects the privacy of Internet Users
and does not collect personally identifying information without the
Internet User's permission. This policy applies to the web sites
owned or operated by OmegaNeT Inc., an Alberta, Canada corporation
("OmegaNeT"). You may contact us regarding this Privacy
Policy by e-mail at legal@omeganet.ca,
or by mail at our headquarters address:
OmegaNeT Inc.
111 New Brighton Mews SE
Calgary, AB T2Z4G8 Canada
1. Some terms used in this Policy are:
- "Client" - which means a person or
organization that has entered into a OmegaNeT Client Service Agreement
with OmegaNeT and operates an OmegaNeT Hosted Web site that sells,
collects leads, advertises to or tracks Internet User members.
- "Referrer" - which means a person or
organization that has entered into a OmegaNeT Advertising Service
Agreement and may be compensated for a sale, lead or click by an
Internet User that the Referrer referred to an Client's Web site.
- "Cookies" - which are small pieces of
information that are stored by an Internet User's browser on the
Internet User's hard drive.
2. Collection of Data:
OmegaNeT does not collect Internet User
identity or contact information from Internet Users' visits to OmegaNeT
Web Sites. For each visitor to a OmegaNeT Web site, the visitor's
computer reaches us via a particular IP, (Internet Protocol), address.
OmegaNeT's servers may automatically collect this IP address for
statistical purposes.
The Internet User's browser may set Cookies
(when enabled) that contain small amounts of data on the Internet User's
computer after a visit to any web site. Cookies assist OmegaNeT in
tracking Internet Users' activities beginning from a Client's web site
or subscription e-mail through to a Referrer's web site that the
Internet User links to from the Client's site or e-mail. If the Internet
User re-visits the Referrer's site directly, OmegaNeT is able to
continue to track the Internet User's activities on the Referrer's site
and reward the Client and/or the Internet User that referred the
Internet User. The Cookies themselves tell OmegaNeT nothing about the
Internet User personally and are not reviewed by OmegaNeT.
Cookies are used in two stages of OmegaNeT tracking:
when a Referrer's banner image is loaded on a Web page for viewing by an
Internet User and when the banner is clicked by an Internet User. The
function of these Cookies is to provide OmegaNeT with information solely
for the purpose of paying Clients commissions when an Internet User
clicks on a link, creates a lead, or makes a purchase on a Referrer's
Web site.
No information is obtained from the Internet User
or Internet User's computer to generate the unique identifying number of
the Internet User. OmegaNeT's servers automatically generate
the unique number. None of OmegaNeT's Cookies are used to perform
"User Profiling".
If you fill out an OmegaNeT provided online contact or
request form, we will need to know your name, e-mail address, mailing
address, and phone numbers. This allows us to process and fulfill your
request and to notify you of your service status.
OmegaNeT does receive and record partial e-mail
addresses of Internet Users, only in circumstances where the Internet
User has voluntarily provided its identity and contact information
through the Referrer's Web site or Client's Web site. This partial
e-mail address does not enable OmegaNeT to personally identify an
Internet User.
If a Web site using OmegaNeT's tracking technology
were to provide any personally identifying information to OmegaNeT
beyond name and/or e-mail address, OmegaNeT would discard that
information immediately.
3. Disabled and Non-functioning Cookies
OmegaNeT does not employ any technology or means of
preventing an Internet User from disabling the acceptance of a Cookie.
Most Web browsers automatically accept cookies, but an Internet User's
browser may be set by the Internet User to disable this function. Some
Web browsers or similar Internet navigating technology may not support
(or consistently support) Cookie technology. If Cookies are disabled or
the Internet User is utilizing technology that does not adequately
support Cookie technology, OmegaNeT may not be able to record the
Internet User's click on a Referrer's link that was placed on a Client's
Web site or within a subscription e-mail or the Internet User's
subsequent activity at the Referrer's Web site.
4. Use and Disclosure of Data
OmegaNeT does not sell, trade or rent personally
identifying information to others. OmegaNeT does not disclose personally
identifying information to anyone that OmegaNeT is not authorized to do
so. OmegaNeT uses anonymous user data to create and report the browsing,
purchasing and/or lead form completion activities of anonymous users.
OmegaNeT reserves the right to release information on
Internet Users if compelled to do so by proper judicial or governmental
authorities. Disclosure shall be limited to only to those that OmegaNeT
is compelled to disclose to. At present, all information processing
occurs in Canada.
5. Security Measures
OmegaNeT employs industry standard security measures
to ensure the security of all data. Access to OmegaNeT customer data is
accessible via password protection through the Referrer and Client
Accounts created by each Referrer and Client, and to designated OmegaNeT
employees who require system level access in order to perform their
jobs. Access to Internet User data that identifies the Internet User's
name and/or e-mail addresses is limited to designated OmegaNeT employees
who require such access in order to perform their jobs and to a Referrer
or Client that provided such information. Each Referrer and Client is
responsible for maintaining the confidentiality of its own password used
for accessing its accounts on the OmegaNeT Network.
When you access your account information, we offer the
use of a secure server. The secure server software (128-bit SSL)
encrypts all information you input before it is sent to us. Furthermore,
all of the customer data we collect is protected against unauthorized
access.
6. Client and Referrer Privacy
OmegaNeT does not share with anyone other than a
Referrer, personally identifiable information about a Client, and vice
versa. Such exchange is limited to a party's e-mail address and basic
Account detail (including but not limited to Web site name (if
applicable), date Web site or subscription e-mail first entered into
operation, and visitor demographics). Such information shall be
accessible to enable each party (a Referrer and a Client) to assess a
potential affiliation with the other party and, when an affiliation has
been established, to facilitate the on-going relationship. The parties
may contact each other before entering into an affiliation (e.g. for the
purpose of soliciting affiliation, and other similar commercial
solicitations) and after an affiliation for the purpose of sending and
receiving targeted commercial e-mail solicitations regarding special
promotions and affiliation opportunities. If an affiliation is
established, the parties are privy to recorded information regarding the
affiliation results, including anonymous Internet User transaction data
for Internet Users referred by the Client. If a Client has been given
permission by the Internet User to record personally identifiable
Internet User transaction data (e.g. through rewards membership
programs), the anonymous Internet User transaction data may be coded by
a Client to enable the Client to generate personally identifiable
Internet User transaction data. Under the foregoing circumstances, the
information remains anonymous to OmegaNeT. By completing the
registration process, Clients and Referrers agree to be solicited by
Referrers and Clients (respectively) for the foregoing purposes. All
other personally identifiable information of Referrers and Clients that
is provided by them during the sign-up process is retained and used by
OmegaNeT in order to serve the Client and the Client's Referrers through
processes such as performance reporting and commission payments to
Clients. Referrers and Clients have agreed with OmegaNeT not to
engage in spamming, unsolicited e-mail and indiscriminate advertising. Each
Referrer and Client may view or modify the information that it provided
during sign-up.
7. Referrer and Client Web Sites and Client
Subscription E-mails
Although OmegaNeT requires Referrers and Clients to
adhere to Good Business Practices as a condition of Membership in the
OmegaNeT Network, OmegaNeT is not responsible for the information
practices of Referrers or Clients. Referrers and Clients may collect
opt-in information from or about Internet Users, including personal
information. The collection, use, and disclosure of information by
Referrers and Clients are subject to their respective privacy policies,
which may differ from OmegaNeT's Privacy Policy.
7.1 Spam
OmegaNeT does not intentionally send unsolicited
e-mail messages that could legitimately be construed as spam. OmegaNeT's
Referrers and Clients are held to the same standards. Any e-mail
sent by OmegaNeT would present the Internet User with an opt-in link, to
be added to an OmegaNeT managed opt-in subscription based email list(s).
Should the Internet User not opt-in, they should not receive any
subsequent OmegaNeT e-mail.
8. COPPA
Since you may not become a member of OmegaNeT's
Network if you are under the age of 18, OmegaNeT complies with the Children's
Online Privacy Protection Act of 1998. Referrers and Clients are
also obligated to comply with COPPA.
If you inform OmegaNeT at abuse@omeganet.ca
that OmegaNeT has collected or received information from a child under
18, OmegaNeT will delete such information immediately from its
databases. No OmegaNeT Web Site is specifically directed to children
under 18. OmegaNeT shall not knowingly distribute to third parties any
personally identifiable information erroneously collected from children
under 18.
9. Deactivating or deleting from databases by
Clients and Referrers
Please contact legal@omeganet.ca
if you no longer wish to maintain an account with OmegaNeT, or are
unable to access your account. If OmegaNeT has such information,
OmegaNeT shall not retain your name and/or e-mail address any longer
than is necessary to perform the services that you requested from
OmegaNeT.
10. Policy Changes
OmegaNeT may find it necessary, or be legally
obligated, to update this Privacy Policy from time to time. Any changes
will be posted at this site. Except as otherwise required by law,
modifications to this Privacy Policy will not affect the privacy of data
collected by OmegaNeT prior to the effective date of the policy
change.
In summary, OmegaNeT is committed to protecting your
privacy.
